Reservation

All information and pictures on the web site of BodyKitsExtreme.com is reserved. All finished product that is shipped to a purchaser is reserved and copyrighted. Any duplication, copying, distribution of BodyKitsExtreme.com without a written consent is illegal, and charges will be filed towards the violator(s).

Customer Security

Customer(s), users and/or members of BodyKitsExtreme.com must agree to all the Terms and Conditions before using any services provided by BodyKitsExtreme.com

Conduct of Users

You agree that you will not:

(i)attempt to transmit any "virus", "trojan horse" or other software destruction or disruption device;

(ii)transmit via or through the Site any information, data, text, files, links, software, chat, communication or other materials that is or which BodyKitsExtreme.com considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, racially or ethnically hateful or otherwise objectionable;

Pictures

All pictures may not represent the actual product, the pictures are for advertising purposes only. All images are property of their respective owners or manufactures.

Please read the description of the product carefully as one or more of the product options may include a different part then shown in the image. The shown product may have extra work including, but not limited to, molding, cutting, or adding to the original piece. Parts such as lights, paint, and others accessories are not included unless specifically specified in the product description

Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, BodyKitsExtreme.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. BodyKitsExtreme.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, BodyKitsExtreme.com shall immediately issue a credit to your credit card account in the amount of the charge.

Information Policies

Information regarding availability of products, prices, phone numbers, emails, etc., are subject to change without notice at all times. Charges, and policies may be changed by BodyKitsExtreme.com at its sole discretion.

Order Acceptance and Submissions

BodyKitsExtreme.com may require additional verifications or information before accepting any order. By placing a credit card order, the customer grants BodyKitsExtreme.com permission to contact their bank to verify name and address for the customers security.

Payment

All customers must pre-pay for all products. We accept payment via major credit cards and PayPal. Orders can be placed online via our secure web site or over the phone. Personal checks, cash, money orders, or bank transfer will not be accepted at this time. All pricing is in US Dollars and we only accept currency in US Dollars. Prices are subject to change at anytime.

Sales Tax

Sales tax is applied to residents of Arizona, but not to any other US State.

Delivery Method/Timing

At BodyKitsExtreme.com, orders placed by 2 p.m. Central Time are usually processed the same day. Many of the products we sell are drop shipped directly from warehouses around the country. We ship majority of our items via UPS or Fedex, but on some merchandise we do use USPS, and freight carriers depending on the item shipment requirement.

Although certain items are kept in stock, some products are custom made to order and require manufacturing time.

Expected ship dates are our best estimate based on past shipping times and are more than 90% accurate. Should an unexpected delay in shipping occur, we will notify you by telephone and e-mail (or letter) of the new projected shipping date and provide you with an opportunity to keep your order or cancel it for a prompt and complete refund.

In-stock items usually ship in 1-2 business days (weekends and holidays are not considered business days). Some oversize items require Freight service (Body Kits, Bumpers, etc..) which might cause a delay in shipment.

Please allow an additional 1 to 5 business days after the shipment date for delivery.

All shipments are sent with full insurance coverage. BodyKitsExtreme.com ships all orders in perfect condition and is not responsible for any damage that may occur during shipment. BodyKitsExtreme.com shall not be responsible for any late shipments. All shipping dates are given as approximate. Buyer shall not be entitled to chargeback's, reductions of price, or other offsets as result of late shipment or failure to deliver in estimated time of delivery. Please inspect the contents of your order BEFORE signing the delivery receipt. Any damages should be noted by the driver on your copy of the delivery receipt and you must make an insurance claim with the shipping carrier to recover damages/loss of shipments. You agree not to refuse shipments for any reason. Refused shipments will be subject to additional shipping charges before replacement items are sent.

Inspection of Your Product Shipment

Upon receiving all products from BodyKitsExtreme.com, please follow the following guidelines...

Buyer shall inspect and reconcile all inbound shipments. Inspect the shipping box and merchandise for any cracks, shortages or damages. The box leaves our facility fully inspected and in perfect condition.

Any damage(s) should be brought to the attention of the delivery driver and noted by the driver on all copies of the delivery receipt. The driver's first and last name should be included in his note of the damage(s).

Be sure to take photos of the damage(s) to the product when delivered.

Any damages in shipment are the responsibility of the carrier; therefore the purchaser must make all damage claims directly to the carrier. BodyKitsExtreme.com shall not be liable under any circumstances for damaged merchandise or for subsequent settlement of the claim with the carrier. However as a courtesy of a seller, we would be glad to help you in reaching an amicable settlement with the carrier in the event that you need assistance.

Damages after acceptance of Product(s)

Returns and Refunds will not be issued due to damages to body kits and other products as the results of buyer or anyone who caused the product to be altered, damaged, blemished or the product has been used or installed on any vehicle. Once the product has been installed or attempted to be installed, we will not accept any returns.

Returns

All products returned to BodyKitsExtreme.com must have a Returned Merchandise Authorization (RMA) issued by BodyKitsExtreme.com. The RMA is valid for 7 days from the date of issuance. The RMA along with the product must be returned to BodyKitsExtreme.com first before replacement or refund will be sent.

All products returned must be in original condition with all items, packaging, including shipping carton, documentation, warranty cards, instructions, and hardware.

Tips: do not throw away your original part(s)!

Customer must pay all shipping fees on any return purchase.

Please verify all orders at time of purchase to make sure you have ordered the correct product.

Please read the labels on the boxes when you receive the product. Returning a product that you later found to be the wrong one shipped after you tried installing it is not grounds for a return.

When contacting us, please have available the product purchase number, date of purchase, buyers name & address and reason for return.

To contact us, click on the Contact Us Button found at the bottom of the page to request an RMA number and return instructions. All non-product related fees (i.e. shipping and handling, etc) are not refundable. Any unauthorized returns will not necessarily be re-stocked and/or refunded.

No cancellations, returns or exchanges are permitted on special order items or custom order items.

Returns; Defective and Damaged Merchandise

Manufactured damage or if fitment is off by extreme margins due to defective manufacturing and the product was not altered, damaged or blemished by the buyer or anyone the buyer allowed to handle, a refund will be considered.

In processing your claim, we require high quality digital pictures of the products to be emailed to the account manager at BodyKitsExtreme.com before an RMA is approved. Include general and close up photos of the defect(s) and in comparison to where it was to be placed or mounted on the vehicle.

Defective merchandise (but only where BodyKitsExtreme.com is providing shipment) may be returned to BodyKitsExtreme.com for full credit, but only upon verification by BodyKitsExtreme.com of such defect or damage. A Returned Merchandise Authorization ("RMA") form must be filled out by the Buyer and Approved by BodyKitsExtreme.com. Credit will be issued to Buyer upon receipt of the RMA form, the claim approval from BodyKitsExtreme.com and the returned merchandise.

Claims must be submitted to BodyKitsExtreme.com no more than ten (10) working days following Buyer's receipt of shipment.

Returns; Exchanges; Good Merchandise

Returns of good merchandise may be accepted by BodyKitsExtreme.com in its sole discretion under the following conditions:

Return/Exchange of merchandise in totally re-saleable condition, without markings on the original packaging will be restricted to extraordinary circumstances with prior approval from BodyKitsExtreme.com. Accepted return will be assessed a 30% restocking charge. Returned part number shall not exceed 15% of total annual purchase quantities.
Return/Exchange of merchandise in packaging that has been marked, relabeled or otherwise defaced will be restricted to extraordinary circumstances with prior approval from your BodyKitsExtreme.com. Accepted return will be assessed a 30% restocking charge, except that BodyKitsExtreme.com merchandise returned in packaging that has been marked, relabeled or otherwise defaced will be subject to a 40% restocking charge. Returned part number shall not exceed 15% of total annual purchase quantities.
Merchandise classified by BodyKitsExtreme.com as TB (To Be Discontinued), or DC (Discontinued), may not be returned for credit.
Merchandise on sales promotion or inventory packages may not be returned for credit.
Buyer must pay all return transportation charges.
Buyer must obtain and complete an RMA form, issued by BodyKitsExtreme.com, for any good merchandise return or exchanges.
Returns/Exchanges will not be accepted under any circumstances after 15 calendar days after the ship date indicated by BodyKitsExtreme.com.
Any returns for non-fitment or quality issues will require high quality digital pictures of the products to be emailed to the account manager before an RMA is approved. If you need to cancel your order, be sure to contact BodyKitsExtreme.com right away. If your credit card has already been charged there will be a 10% order processing fee assessed. If your item has already been shipped then you must follow the return policy stated above after receiving the product.
Order cancellations will take up to 48 hours after a cancellation is requested before the order is officially cancelled and money processed for return.

Act of Malice and Fraud

Any product returned to us that is not our own product is an act of malice and fraud. Some items (and eventually all) contain hidden security identifiers which must be intact when we receive the product. We will not replace or return the product if it is being passed off as one of our own or does not contain the marking. We will report such actions to the postal service (for mail fraud), and any applicable local law enforcement. The item sent to us will be disposed of without further recompense.

Product Warranty

Warranty & Returns of All parts and products sold by BodyKitsExtreme.com are sold on an as is basis, the only warranties applying to these parts are those that may be offered by the manufacturer as limited warranties. Federal, State and DOT/SAE Vehicle Laws Product sold by BodyKitsExtreme.com are aftermarket products.

Due to strict regulations by the Department of Transportation, U.S. Federal and State Vehicle Laws and Safety Crash Guidelines, some products are not approved for street or highway use.

BodyKitsExtreme.com is not responsible or liable for any damages or possible injury incurred upon possible accidents due to driver error, bad judgment (cracking or breaking of any parts) or act of nature/God.

Alterations, Removal or Damages to OEM Safety parts and or equipment such as but not limited to safety reinforcements, bumpers, turn signals, and other safety equipment on any vehicle is the responsibility of the buyer.

BodyKitsExtreme.com is not liable for any damages or injury as a result of these products and BodyKitsExtreme.com is not liable or responsible for the buyers actions.

Installation of Products, Body Kits and Product Liability

Some parts, especially body kits may require prepping, sanding, shaving, filling gaps, cutting, or other extensive body work. By complying with our policies, customer understands the procedure and possible difficulty in installing body kits and other products. We HIGHLY recommend that a professional body shop with custom body kit experience perform the installation.

BodyKitsExtreme.com is not responsible for any extra-incurred fees, material fees, storage fees, unexpected labor cost for required installation or any consequential damages, damages to property, damages for loss of use, loss of time, loss of profit, loss of income, any costs of modification/installation, or any other incidental or secondary damages.

Please check your local laws and research the parts you wish to purchase to insure they are the correct items you want to purchase.

Not all parts will fit perfect or perform as desired. This is the nature of aftermarket accessories and parts. BodyKitsExtreme.com hereby expressly disclaims all warranties either expressed or implied, including any implied warranties of merchantability or fitness for a particular purpose and neither assumes, nor authorizes any other person(s) to assume for it any liability in connection with the sale of these parts.

User and Member Information

BodyKitsExtreme.com owns any information you provide through your use of the website, including any information regarding your use of the Internet and the website. Subject to the terms of our Privacy Policy, BodyKitsExtreme.com reserves the right to reproduce and use such information for its own marketing or other purposes. Such information will not be sold or otherwise provided to any third party without your consent.

Indemnification

Applicable Law and Consent to Jurisdiction

This Agreement will be governed by and in accordance with the laws of the State of Arizona, USA without regard to its conflicts of law provisions. You agree to submit to the personal jurisdiction of the courts of Gilbert, Arizona, USA for any cause of action arising out of or relating to this Agreement.

Shortened Statute of Limitations

You agree to file any cause of action arising out of or relating to this Agreement and your rights and obligations hereunder in Gilbert, Arizona, USA within one year after the cause of action arises. You agree that any action filed after this date is barred.

Right to Change Agreement

BodyKitsExtreme.com reserves the right to change this Agreement at any time. BodyKitsExtreme.com will post a notice of any change to this Agreement on the web site. Your continued use of the web site after any such change is made constitutes acceptance of and agreement to be bound by the terms of the Agreement as modified. Only BodyKitsExtreme.com can modify the terms and conditions of this Agreement and/or the Credit Schedule.

Severability

If any provision of this Agreement is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

Entire Agreement

This Agreement constitutes the entire agreement between you and BodyKitsExtreme.com and supersedes all proposals and other communications made between the parties, written or oral. This Agreement can only be modified as stated in Section 19 above.

ORDER SECURITY

(We think that) Security and satisfaction is our main goal. All information provided by you is confidential and will not be released to any third parties. To insure confidentiality, we use the SSL (Secure Sockets Layer) protocol (provider by Thawte) for transferring data. SSL is a cryptosystem that creates a secure environment for the information being transferred between your browser and our Server.
